Terms of Service
Effective October 6, 2026. Last updated October 6, 2026.
These Terms govern use of Quill Hound Voice (the "Service"), operated by Quill Hound ("we", "us"). "Customer" means the organization that signs up for the Service; "Users" are the people the Customer adds to its workspace. By ticking the box to accept these Terms, or by using the Service, you agree to them on behalf of yourself and, if you are setting up the Service for an organization, that organization. If the Customer has signed a separate written agreement or order form with us, it controls where it conflicts with these Terms.
1. The Service
Voice provides business calling, texting, call recording, transcription, AI-written summaries and drafts, and CRM integrations. We may improve or change features; we will not materially reduce the core calling service during a paid term without notice.
2. Accounts
Workspace admins create User accounts and are responsible for who has access. Keep passwords confidential and tell us promptly about any unauthorized use. The Customer is responsible for its Users' actions in the Service.
3. Plans, billing and automatic renewal
- There is no online signup or online payment today: workspaces are set up by us after you contact us, and are billed by invoice under an order form. Plans are priced per user per month, as shown on our pricing page or your order form. Prices exclude taxes and carrier surcharges.
- Subscriptions renew automatically at the end of each billing period (monthly unless your order form says otherwise) at the then-current price until cancelled. We will tell you at least 30 days before any price increase takes effect.
- Cancelling: because signup is by email, so is cancelling: a workspace admin can cancel at any time from Settings ("Cancel subscription", which opens a pre-filled email) or by emailing jglass@quillhound.com, and we confirm in writing. Cancelling stops the next renewal; the Service stays available until the end of the period already paid, and we do not charge again. Fees already paid are not refundable except where the law requires.
- Usage beyond a plan's included minutes, and phone numbers, may be billed as described in your order form.
4. Customer responsibilities: recording, texting and calling laws
- Call recording. The Customer decides whether calls are recorded and when callers hear a recording announcement. Recording laws differ by state and country; some require every party's consent. The Customer is responsible for giving any notice and getting any consent its calls require. The built-in list of two-party-consent states is a convenience, not legal advice.
- Texting. The Customer must have the consent required by law (including the TCPA) before texting anyone, follow carrier rules (including A2P 10DLC registration), and honor opt-outs. Voice blocks texts to contacts who replied STOP; do not work around that.
- Calling. The Customer is responsible for telemarketing and do-not-call rules, caller ID accuracy, and emergency-calling limits explained below.
- Health information. We do not currently sign Business Associate Agreements. Do not use the Service to create, receive, store or transmit protected health information under HIPAA unless we have signed a BAA with you in writing.
5. Emergency calls
The Service is not a replacement for a traditional phone line for emergency calls. Browser calling depends on power, internet access and the device; location may not be sent to emergency services. Keep another way to reach emergency services.
6. Acceptable use
You will not, and will not let anyone else:
- break any law, including recording, privacy, telemarketing, anti-spam or consumer-protection laws;
- send unsolicited bulk messages, robocalls, or messages that are fraudulent, harassing, threatening or deceptive;
- spoof caller ID or impersonate anyone;
- upload malware, probe or break our security, or access data that isn't yours;
- overload the Service, scrape it, or reverse engineer it except where the law allows;
- resell the Service without our written permission; or
- use it for anything that could get our phone numbers or messaging campaigns suspended by carriers.
We may suspend use that breaks this section or puts the Service, carriers or other customers at risk, and will tell you why when we can.
7. Customer data and AI
The Customer owns the data it and its Users put into the Service and the recordings, transcripts and summaries made from it ("Customer Data"). We use Customer Data only to provide, secure and support the Service, as described in our Privacy Policy and DPA. We do not use Customer Data to train AI models, ours or our vendors', without the Customer's explicit opt-in. AI-written summaries and drafts can be wrong; review them before relying on or sending them.
8. Third-party services
Integrations the Customer connects (Salesforce, Bullhorn, a webhook, Quill Calls) are governed by the Customer's agreements with those providers. We are not responsible for them, though we will keep our side of the integration working in good faith.
9. Availability and support
We work to keep the Service available and to fix problems promptly, but we do not promise uninterrupted or error-free service and offer no uptime guarantee or service credits unless a signed order form says so. The Service depends on carriers, hosting providers and the internet, which we do not control. Support is by email at jglass@quillhound.com.
10. Our intellectual property
We own the Service and its software. We grant the Customer a non-exclusive, non-transferable right to use it during the subscription. If you send us feedback, we may use it without obligation.
11. Disclaimer of warranties
Except as expressly stated in these Terms, the Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement, and any warranty that the Service, transcripts or AI output will be accurate, uninterrupted or error-free.
12. Limitation of liability
To the fullest extent permitted by law: (a) neither party is liable for indirect, incidental, special, consequential or punitive damages, or lost profits, revenue, data or goodwill, even if advised of the possibility; and (b) each party's total liability arising out of or relating to these Terms or the Service is limited to the greater of the fees the Customer paid us for the Service in the 12 months before the event giving rise to the claim, or one hundred U.S. dollars ($100).
These limits do not apply to the Customer's payment obligations, a party's indemnity obligations, or liability that cannot be limited by law.
13. Indemnity
The Customer will defend and indemnify Quill Hound against third-party claims, and resulting losses and costs (including reasonable attorneys' fees), arising from the Customer Data, the Customer's or its Users' use of the Service in breach of these Terms or the law (including recording-consent, texting and telemarketing laws), or the Customer's integrations. We will defend and indemnify the Customer against third-party claims that the Service, as we provide it, infringes their intellectual property. The party seeking indemnity must notify the other promptly, let it control the defense, and cooperate reasonably.
14. Term and termination
These Terms last while the Customer uses the Service. Either party may end the subscription as described in section 3. Either party may terminate if the other materially breaches these Terms and does not fix it within 30 days of written notice. We may suspend or terminate immediately for serious or repeated breaches of section 6. On termination, access ends; the Customer may ask for an export of its data within 30 days, after which we delete it as described in the Privacy Policy. Sections that by their nature should survive (including 7, 11, 12, 13 and 16) survive.
15. Changes to these Terms
We may update these Terms. We will post the new version here with a new date and, for material changes, notify workspace admins at least 30 days before they take effect and ask Users to accept the new version at their next sign-in. Continuing to use the Service after the effective date means accepting the change. If you do not agree, cancel before it takes effect.
16. Governing law and general terms
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, and the state and federal courts located in Texas have exclusive jurisdiction. Neither party may assign these Terms without the other's consent, except to a successor in a merger or sale of substantially all of its business. If a provision is unenforceable, the rest stays in effect. These Terms, the Privacy Policy, the DPA and any order form are the entire agreement on this subject.
